As ("Company"); The privacy and security of your personal data are among our top priorities. Our company processes your personal data in accordance with the regulations of the Personal Data Protection Law No. 6698 ("KVKK") and secondary legislation. We would like to inform you about your personal data processed if you become a Platform User in order to benefit from time tracking, shift planning, leave management, break tracking, geographical location verification and reporting services (collectively "Platform Services") offered through the Clocktice mobile application, web platform and all related services (collectively "Platform"). --- ## 2 - Two Different Data Categories and Our Roles Two different categories of personal data are processed at Clocktice: **A - Platform Operation Data (as Data Controller):** Our Company is the **data controller** for data within the scope of account management, platform security and direct communication of administrators and operation users. **B - Employee Data (as Data Processor):** Our Company is a **data processor** for entry-exit records, location data, leave records, break times and performance data of the employees of customer companies. **The data controller for this data is the customer company.** > **Customer company liability:** Companies using Clocktice; It is responsible for informing its employees within the scope of KVKK about the scope and processing of the collected data, creating the necessary legal basis and fulfilling its legal obligations regarding the processing of employee data. --- ## 3 - Special Statement on Biometric Data and Location **Face Recognition (Optional):** Clocktice allows personnel entry-exit verification via optional facial recognition. Facial recognition data is **biometric data** and is considered as special personal data within the scope of KVKK. Customer companies using this feature are obliged to obtain **explicit consent** from their employees and fulfill additional legal obligations regarding processing this data. **QR Code and Cameraless Entry:** QR code or cameraless verification methods can also be used instead of face recognition. **Geographic Location Verification:** Geographic location verification can be performed at personnel entrances and exits. This feature is used to confirm that employees are at the specified location. Customer companies are obliged to inform their employees about the scope of this application. --- ## 4 - Which Personal Data Do We Process? ### Administrators and Operations Users (as Data Controller) **User Account Information:** Your e-mail address, password (one-way hash), name, surname, job title and company information. **Company Profile Information:** Company name, address, tax number, branch structure and organizational information. **Session and Access Data:** Login records, IP address, application version, access hours. **Billing Data:** Subscription plan, payment dates, transaction records. Card information is processed through the payment provider; It is not stored in Clocktice systems. ### Employee Data (as Data Processor) **Identity Information:** Employee name, surname and employee identification number (information entered into the platform by the customer company). **Entry-Exit Records:** Employees' entry and exit times, registration date and registration type (QR, with camera, without camera). **Geographic Location Data:** Location information received at the time of entry and exit (depending on the customer company's preference). **Biometric Data (Optional):** Facial recognition data if facial recognition feature is used. **Break Records:** Break start and end times, break durations. **Leave Records:** Leave type (annual, unpaid, report, etc.), leave dates, request and approval status, remaining leave entitlement. **Shift Information:** Scheduled shifts, shift changes, working hours. **Performance and Reporting Data:** Monthly working hours, weekly entry-exit summaries, break statistics. > **Sensitivity of employee data:** Entry-exit records, location data and especially biometric data are sensitive data that concern the most basic personal rights of employees. Clocktice processes this data only in accordance with the instructions of the customer company and for the purpose of providing the relevant services. --- ## 5 - Legal Reasons and Purposes of Processing Your Personal Data **Account Creation and Management:** Contract execution, account management, security. **Provision of Platform Services:** Entry-exit tracking, shift planning, leave and break management, reporting. *Legal Reason: Performance of the contract.* **Processing of Employee Data (as Data Processor):** Keeping and reporting employee records on behalf of the customer company. *Legal Reason: Performance of the contract (customer company agreement).* **Location Verification (as Data Processor):** Confirmation that employees are in the specified location. *Legal Reason: Legitimate interest of the customer company / employee consent (customer company responsibility).* **Biometric Data Processing (as Data Processor — Optional):** Authentication by facial recognition. *Legal Reason: Employee's **explicit consent** (must be obtained by the customer company).* **Integration Services:** API integration with ERP, CRM and accounting systems. *Legal Reason: Performance of the contract.* **Security and Audit:** Preventing unauthorized access, audit log. *Legal Reason: Legitimate interest.* **Legal Transactions:** Fulfillment of legal obligations. *Legal Reason: Legal obligation.* --- ## 6 - To whom do we transfer your personal data? **Cloud Infrastructure:** With our IT infrastructure providers for platform operations (with standard contract assurance). **Payment Provider:** Integrated payment provider for processing subscription payments. **SMS Provider:** SMS service provider for leave request notifications. **Integration Partners:** ERP/CRM systems to which the customer company is connected within the scope of API integration (with the guidance of the customer company). **Legal Proceedings:** Regulatory bodies, courts, with our lawyers. > Clocktice does not share employee login and logout records, location data or biometric data with advertising platforms or data brokers. --- ## 7 - Your rights You have the right to learn whether your personal data is being processed or not, to request information, to learn its purpose and suitability for purpose, to learn about domestic/international transfers, to request correction, deletion or destruction, to object to a decision being made against you through automatic systems, and to request compensation for damages. > **For employees:** Please inform your employer who registered you in Clocktice about your rights regarding your personal data in the Clocktice system.
